1 Acceptance of Terms
By accessing or using DineSwift ("the Service," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.
These Terms apply to all visitors, users, and anyone who accesses or uses the Service, including hotel owners, kitchen staff, cashiers, and guests placing orders.
Note: If you are accessing DineSwift on behalf of a business or hotel, you represent and warrant that you have the authority to bind that entity to these Terms.
2 Service Description
DineSwift is a hotel restaurant management platform that enables:
- QR-code-based digital menu browsing and ordering for hotel guests.
- Real-time order management for kitchen and cashier staff.
- Analytics, menu management, staff management, and promo code management for hotel owners.
- Payment processing via integrated third-party gateways (currently Chapa).
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
3 Accounts & Access
Account creation: Staff accounts (owner, kitchen, cashier) are created and managed by the hotel owner. You are responsible for maintaining the confidentiality of your login credentials.
Account security: You agree to:
- Use a strong, unique password and not share it with others.
- Notify us immediately at support@DineSwift.com if you suspect unauthorised access to your account.
- Log out of your account after each session on shared devices.
Guest access: Hotel guests accessing the ordering menu via QR code do not require an account. No personal information is required from guests to place an order.
Important: You are responsible for all activity that occurs under your account. We are not liable for any loss arising from your failure to maintain account security.
4 Acceptable Use
You agree not to use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Transmit any unsolicited or unauthorised advertising or promotional material (spam).
- Attempt to gain unauthorised access to any part of the Service, servers, or connected systems.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Upload or transmit malicious code, viruses, or any software intended to damage or interfere with the Service.
- Use the Service in any way that could disable, overburden, or impair its infrastructure.
- Harvest or collect personal data of other users without their consent.
- Impersonate another person, business, or entity.
Violation of these rules may result in immediate account suspension or termination, at our sole discretion.
5 Content & Intellectual Property
Your content: You retain ownership of all content you upload to the Service (e.g., menu item images, descriptions). By uploading content, you grant DineSwift a non-exclusive, royalty-free licence to display that content within the Service for the purpose of providing the Service to you.
Our content: All software, code, designs, logos, and other materials comprising the Service are the exclusive property of DineSwift and are protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works without our express written permission.
Feedback: Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without any obligation to compensate you.
6 Payments & Billing
Guest payments for orders are processed through Chapa, a third-party payment gateway. By initiating a payment, you agree to Chapa's terms of service and privacy policy.
DineSwift does not store raw credit or debit card information. Payment data is handled directly by Chapa using industry-standard encryption (PCI DSS compliance).
All prices displayed in the Service are set by the hotel owner and are exclusive of any applicable taxes unless explicitly stated. DineSwift is not responsible for pricing errors entered by hotel staff.
Refunds and disputes relating to guest orders are handled by the hotel. DineSwift is not a party to the commercial transaction between the hotel and its guests.
7 Service Availability
We aim to keep DineSwift available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, unexpected outages, or circumstances beyond our control (force majeure).
We will endeavour to provide advance notice of planned maintenance where possible. We are not liable for any losses arising from temporary unavailability of the Service.
8 Disclaimers & Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, DineSwift shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, goodwill, or other intangible losses.
- Damages arising from unauthorised access to or alteration of your transmissions or data.
- Damages arising from the conduct of any third party (including guests or payment providers).
Liability cap: In no event shall DineSwift's aggregate liability exceed the amount you paid (if any) to use the Service in the 12 months preceding the claim.
9 Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.
You may terminate your use of the Service at any time by ceasing to use it and, if applicable, contacting us to deactivate your account.
Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
10 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Addis Ababa, Ethiopia. You consent to the personal jurisdiction of those courts.
11 Changes to These Terms
We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify active users via email or an in-dashboard notice.
Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.
